Welcome to Dudegevity (“Dudegevity,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website, mobile application, AI-powered tools, voice features, social features, content, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old to use the Services.

2. Limited Mobile App License
Subject to these Terms, Dudegevity grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the mobile application for your personal, non-commercial use on devices you own or control.
You may not:

* modify,
* distribute,
* sublicense,
* reverse engineer,
* or create derivative works from the application except as permitted by law.
This license is limited to use of the Services in compliance with these Terms and applicable app marketplace rules.
Apple Inc. and Google are not responsible for the Services or their content and have no obligation to provide maintenance or support services.
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

3. Health and Wellness Disclaimer
Dudegevity is intended for informational, educational, entertainment, motivational, and general wellness purposes only.
The Services:
* do not provide medical advice;
* do not diagnose, treat, cure, or prevent any disease;
* are not a substitute for professional medical advice, diagnosis, or treatment.
Always consult a qualified healthcare provider before making health, fitness, nutrition, supplement, or lifestyle changes.

You acknowledge that:
* exercise, dieting, fasting, supplementation, and wellness activities involve inherent risks;
* any actions you take based on information provided through the Services are at your own risk.

4. AI-Generated Content
The Services may include AI-generated responses, recommendations, summaries, commentary, or conversational interactions (“AI Content”).
AI Content:
* may be inaccurate, incomplete, offensive, sarcastic, provocative, or inappropriate;
* may use humor, satire, exaggeration, or comedic commentary;
* should not be relied upon as factual, medical, nutritional, legal, financial, or psychological advice.
You understand and agree that:
* AI systems can make mistakes;
* AI-generated content may not be appropriate for all users;
* you are solely responsible for evaluating any information provided;
Dudegevity is not responsible for decisions made based on AI Content.
4a. Calorie, Nutrition, and Activity Estimates
The Services may provide estimated calorie counts, nutritional information, exercise activity data, calorie expenditure estimates, wellness metrics, and related information generated through artificial intelligence systems, third-party databases, user inputs, algorithms, or other automated methods.
Users acknowledge and agree that:
* calorie counts, nutritional values, and activity estimates are approximations only;
* food recognition, voice recognition, image recognition, and user-provided descriptions may be incomplete, inaccurate, or misunderstood;
* portion sizes, ingredients, preparation methods, serving quantities, and exercise intensity may not be accurately reflected in calculations;
* exercise calorie burn estimates may vary significantly from actual energy expenditure;
* information obtained from third-party databases may contain inaccuracies, omissions, or outdated information;
* AI-generated estimates may be incorrect, incomplete, or based on assumptions that do not reflect actual consumption or activity.
Dudegevity does not guarantee the accuracy, completeness, reliability, or suitability of any calorie, nutrition, exercise, wellness, or activity-related information provided through the Services.
Users are solely responsible for evaluating and verifying any information used to make dietary, fitness, health, or lifestyle decisions.
The Services are intended to provide general wellness tracking and informational assistance only and should not be relied upon for medical, nutritional, weight-loss, athletic training, or healthcare purposes.

5. User Accounts
You may be required to create an account to access certain features.
You agree to:

* maintain the security of your account credentials;

We reserve the right to suspend or terminate accounts that violate these Terms.

The Services may allow users to:

* participate in group challenges,
* exchange comments or reactions,
* view certain wellness-related activity,
* or interact through AI-generated or user-generated content.
By using social features, you acknowledge and agree that:
* information you choose to share may be visible to other users within the Services;
* by inviting, connecting with, or interacting with other users, you consent to sharing selected profile, wellness, activity, and engagement information within the Services;
* Dudegevity is not responsible for the conduct, content, statements, or actions of other users;
* interactions between users are solely between those users.
We reserve the right, but not the obligation, to monitor, review, remove, restrict, or moderate user content and interactions.

8. User Content
You may submit data, text, photos, food logs, exercise logs, prompts, comments, audio, or other content (“User Content”).
You retain ownership of your User Content.
By submitting User Content, you grant Dudegevity a non-exclusive, worldwide, royalty-free license to:

* reproduce,
* modify,
* display,
* and use such content solely for operating, improving, and providing the Services.
You represent that:
* you own or have the necessary rights to your User Content;
* your User Content does not violate any law or third-party rights.
We may remove User Content at our discretion.

9. Community Safety and Objectionable Conduct
Dudegevity maintains a zero-tolerance policy for:
* unlawful harassment,
* threats,
* hate speech,
* targeted abuse,
* sexually exploitative content,
* promotion of self-harm,
* encouragement of eating disorders,
* or malicious conduct directed toward other users.
Users may report objectionable content or abusive behavior through in-app reporting tools or support channels.
We reserve the right to:
* remove content,
* suspend features,
* restrict accounts,
* or terminate users
who violate these standards.

10. Wellness Safety Notice
The Services are not intended to diagnose or treat eating disorders, body dysmorphia, compulsive exercise behaviors, or mental health conditions.
We reserve the right, but not the obligation, to:
* limit or restrict certain features,
* issue warnings,
* provide educational resources,
* or intervene in platform activity
if we detect patterns reasonably associated with dangerous wellness behavior, severe caloric restriction, self-harm concerns, or platform misuse.
Dudegevity is not a crisis-response, medical monitoring, or emergency intervention service.
If you believe you may be experiencing a medical or mental health emergency, contact a qualified healthcare provider or emergency services immediately.

14. Subscriptions and Automatic Renewals
Certain Services may be offered on a subscription basis.
BY PURCHASING A SUBSCRIPTION, YOU AUTHORIZE RECURRING CHARGES UNTIL CANCELED.
Subscriptions automatically renew unless canceled before the renewal date.
You may cancel at any time through:
* your Apple App Store or Google Play account settings;
* your account settings within the Services where available;
* or by contacting support.
If you cancel, your subscription will remain active until the end of the current billing period.
We will present material subscription terms, pricing, renewal frequency, and cancellation information prior to purchase in compliance with applicable law, including California Automatic Renewal Law.
Fees are generally non-refundable except where required by law.
We may change pricing or features at any time with reasonable notice.

* OR THAT RESULTS WILL MEET YOUR EXPECTATIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUDEGEVITY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR:

* SPECIAL,
* CONSEQUENTIAL,
* EXEMPLARY,
* OR PUNITIVE DAMAGES,
INCLUDING DAMAGES FOR:
* LOSS OF DATA,
* LOSS OF PROFITS,
* PERSONAL INJURY,
* HEALTH OUTCOMES,
* INACCURACIES IN CALORIE, NUTRITION, EXERCISE, WELLNESS, OR ACTIVITY ESTIMATES,
* EMOTIONAL DISTRESS,
* OFFENSE TAKEN FROM AI-GENERATED OR COMEDIC CONTENT,
* USER INTERACTIONS,
* OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
* $100 USD,
* OR THE AMOUNT YOU PAID TO US IN THE PRECEDING 12 MONTHS.

18. Indemnification
You agree to indemnify and hold harmless Dudegevity and its affiliates, employees, contractors, and partners from claims, liabilities, damages, losses, and expenses arising from:
* your use of the Services;
* your User Content;
* your interactions with other users;
* your violation of these Terms;
* your violation of applicable law or third-party rights.

19. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for disputes eligible for small claims court, you and Dudegevity agree to resolve disputes arising out of or relating to these Terms or the Services through final and binding individual arbitration.
You waive:
* the right to a jury trial;
* the right to participate in a class action lawsuit;
* and the right to participate in class-wide or representative proceedings.
Arbitration shall be conducted in California under the rules of the American Arbitration Association.
Any arbitration shall occur on an individual basis only.
If any portion of this section is found unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
Some jurisdictions may not allow certain arbitration limitations, so portions of this section may not apply to certain users.

We may suspend or terminate your access to the Services at any time, with or without notice, if:
